THIS AGREEMENT IS GOVERNED BY THE FOLLOWING RULES AND CONDITIONS: 1. This agreement will be governed by the laws of the state of Georgia, USA. 2. Order Your Domains will NOT sell, lease or give out your email address, mailing address, telephone number or any other confidential information you submit 3. An affiliate may sign up only once. 4. Order Your Domains believes in a STRICT NO SPAM policy. Any affiliate caught using bulk e-mail, inappropriately posting in newsgroups or participating in any other format of SPAM, may have their account immediately terminated. All sales commission due the affiliate will be forfeited! 5. Order Your Domains will give you (the 'Affiliate') a commission based on the sale price of products/services sold through a direct referral from your Affiliate's web site. The rate of commission is 10% on the your personal direct sales(excluding shipping and taxes). For your direct downline, the rate of commission you shall receive is 5% of the their gross sales sales 6. This agreement is purely for giving commissions on sales effected through referrals from the Affiliate's website as an independent contractor. The term, 'Affiliate', does not imply any formal association with Order Your Domains. The Affiliate understands that they do not have any right on our products, processes, logos or trademarks. 7. The Affiliate is not permitted to represent Order Your Domains in any way other than advertising their own web site page. If the affiliate already has their own site, they may also use any of the approved banners that are provided by Order Your Domains. 8. We reserve the right to alter any and all policies at anytime. As for commissions any credit accumulating after such change will be at the new rate. The Affiliate is not guaranteed to have the same rate as the one started with. It is the obligation of the affiliate to keep up with any policy changes via email sent to each affiliate as per in there personal profile unless otherwise changed in the future. 9. We reserve the right to change the product or service prices at any time. These changes may or may not have an effect on the commission, at sole discretion of Order Your Domains. 10. The commission is credited only when the payment for the sale of the product or service is cleared. If the buyer requests a refund, the original commission credited can be deducted. All approved commissions from the previous month shall be sent out by the 15th of the following month, each month. If the cancellation is due to the fault of Order Your Domains or any of it's employees, the affiliate will be allowed to keep the commission. This determination is made by Order Your Domains exclusively. 11. We will not be responsible for any cookie failure that may result in the user's clicks going unregistered. If this problem should arise, please notify us at Order Your Domains immediately and we will do our best to investigate and remedy the problem. 12. All Affiliates that are due commissions, are paid monthly. A minimum balance of $15,00 (US)is required in order for one to be paid! Should your commissions be less then the said minimum for any given month, your commissions shall be accrued each month until such time they amount to $15.00 or more. 13. Due to the World Wide nature of our business, we may issue an International Money Order for the equivalent to the US dollar amount at the prevailing exchange rate on the date of issue. 14. We reserve the right to evaluate your site and terminate individual agreements after notification through E-mail. In such situations, our sole responsibility ends at issuing a check corresponding to the outstanding amount in your credit. 15. We reserve the right to cancel the whole Affiliate program without notice. As in the previous case, if it happens all Affiliates will be issued with a check corresponding to any outstanding amount in their credit. 16. Any correspondence relating to the loss of the check due to USPS or courier, or inability to cash the check, must be sent within a reasonable time to let us decide on alternative payment method(s) if any. 17. All U.S. affiliates will provide Order Your Domains with a valid Social Security or E.I.N.(Employer Identification Number) for yearly issuance of 1099 forms for tax purposes 18. Any tax liability on the amount of commission received will be the Affiliate's responsibility. 19. Only the banners/icons recommended or approved by us are to be used in the link or in association with Order Your Domains. 20. Only ads and marketing materials approved in writing by Order Your Domains may be used in the marketing of the products or services. 21. It should clearly be understood that a direct correlation between 'click-throughs' and sales may not exist. All operations are automatic (or semiautomatic) and hence no valid sales referred by you will go unrecorded. E-mail correspondence regarding click through vs. sales will be answered in a timely manner. 22. Under no circumstances can an affiliate sell or transfer any or all of their commissions or affiliate member ID. 23. To agree to this agreement, you must be of legal employment age in your local area of residence.
